Terms of Service

1. Who we are, and this agreement

Memories Around is run by Ruslan Stadnik from the Netherlands ("we", "us"). You can reach us at support@memoriesaround.com.

These terms apply to the Memories Around app and this website (the "Service"). By creating an account or using the Service, you agree to them and to our Privacy Policy. If you do not agree, do not use the Service.

2. Your account

You must be at least 13 years old, or older where your country requires it. An account belongs to one person. Keep your sign-in details to yourself; you are responsible for what happens under your account. Do not pretend to be somebody else, and keep the details you give us accurate.

3. Using the app

We give you a personal, non-exclusive, non-transferable right to use the Service for your own, non-commercial purposes — or, on the Business plan, to present your business. The app itself — its design, code, name and logo — belongs to us. Do not copy, modify, resell or reverse-engineer it, except where the law expressly allows you to.

4. What you leave here

Your memories are yours. You keep ownership of everything you post: memories, photographs, comments and business listings.

So that the Service can work, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, resize, process and display that content, and to show it to the people allowed to see it. The licence is only for running and improving the Service, and it ends when you delete the content, apart from backups, which expire within 30 days. We do not sell your content or use it in advertising.

• A public memory can be seen by anyone looking at that part of the map, with your display name and photograph. Aprivate memory is seen only by you.
• A comment can be seen by anyone who can see the memory it was left on. You can turn comments off for any memory of yours.
• A memory is pinned where it happened and the pin cannot be moved afterwards. You can change its words, photograph, mood, visibility and the place it belongs to, or delete it entirely.

You are responsible for what you post, and you confirm that you have the right to post it. We cannot recall a copy somebody else has already shared outside the app.

If you send us ideas or feedback, we may use them freely and without owing you anything.

5. What does not belong here

Do not post:

• Anything unlawful, abusive, hateful, threatening or harassing.
• Sexual content, or anything that sexualises or endangers children.
• Anything that is not yours to post, such as a photograph somebody else took.
• Anything that exposes somebody else's private life — a photograph of a person who did not agree to it, an address, a name attached to something they would not want attached to it.
• Advertising, spam, or fake memories and comments written to promote or run down a place.

And do not:

• Collect other people's content or data from the Service with bots or scrapers.
• Get around the limits of your plan, interfere with how the Service runs, or try to reach data that is not yours.

6. Reporting, blocking and moderation

You can report any memory or comment from inside the app. It disappears for you straight away. Once enough people report the same thing, or as soon as one report says it is sexual or violent, it is hidden from everyone while a person reviews it. You can also report illegal content, including from outside the app, by writing to support@memoriesaround.com.

After review we may remove the content, restore it, limit where it is shown, or suspend or close the account behind it. If we act against your content or account, we will tell you what we did and why, unless the law or someone's safety prevents it. If you think we got it wrong, reply to us and a person will look at it again.

You can block any account. From then on, neither of you sees the other's memories or comments, and neither of you can comment on the other's memories. The other person is not told.

7. Memories written by AI

Some memories on the map are written by an AI model, not by a person who was there. They carry an AI label, and the account that posted them says so. Treat them as fiction: they are not reviews or facts about a place.

8. Places

Places come from two sources. Most are cultural places, landmarks and viewpoints we add from public data such as OpenStreetMap, with photographs from Wikimedia Commons used under their own licences. The rest are listed by businesses, as described below.

We do our best to keep places accurate, but opening hours, contact details and links can go out of date, and we cannot guarantee them. Links on a place page lead to websites we do not control and are not responsible for. If something about a place is wrong, tell us.

9. Business listings

Listing a place needs the Business plan. By listing one, you confirm that you run the business or are allowed to act for it, and that what you enter is accurate and lawful. Use the business's contact details, not personal ones.

• Every listing is reviewed by a person before it appears, usually within a week. We may refuse a listing, with a note explaining why, or remove one later.
• An approved listing carries a Verified Place mark. It means we checked the listing against the business's public details. It is not an endorsement, an inspection or an in-person visit, and it does not guarantee anything about the business.
• The memories other people leave at your place belong to them, not to you. You can report one that breaks these terms, like anyone else.
• There is no paid ranking. What people see depends on how close they are.
• If you delete your account, your listing stays on the map, no longer linked to you. Write to us if you want it removed as well.

10. Location and staying safe

Location features depend on your device, its permissions and its signal. A pin may be a little off, and an alert may arrive late or not at all. Do not rely on the Service for anything where that matters.

Pay attention to where you are, not to the app. Do not use it while driving, and do not enter private property or break local rules to visit a place or leave a memory.

11. Plans and subscriptions

The Service has a free plan and two paid ones, Premium and Business. The free plan has limits — on how many memories you can post each day, how many you can save, and how far from you the feed reaches. The paid plans raise or remove those limits and add features such as background alerts and searching anywhere on the map. The current limits are shown in the app and on our pricing page. We may change plans and their features; a change to a paid plan applies from your next billing period.

Paid plans are bought through the App Store or Google Play, billed in your own currency, and renew automatically until you cancel. Payment, renewals, cancellations and refunds — including any right to withdraw from the purchase — are handled by the store under its terms, not by us. We cannot cancel or refund a subscription on your behalf. Deleting your account does not cancel a subscription; cancel it in your store account first.

12. Apple and Google

If you downloaded the app from the App Store or Google Play, these terms are between you and us, not Apple or Google. We, not they, are responsible for the app, its content, its maintenance and support, and for handling any claims about it — including claims that it breaks the law or someone else's intellectual property. Apple and Google are not obliged to support the app. If the app does not work as it should, you may tell Apple and it may refund the purchase price, if any; beyond that, Apple has no warranty obligation. Apple and its subsidiaries may enforce these terms against you as a third-party beneficiary. You confirm that you are not in a country under a U.S. embargo and not on a U.S. list of prohibited or restricted parties. The store's own terms also apply.

13. Ending it

You can stop using the Service and delete your account at any time; see deleting your account. We may suspend or close an account that seriously or repeatedly breaks these terms, and remove what it posted. We may also stop offering the Service altogether; if we do, we will tell you in advance where we can and give you a way to get a copy of your data. Sections 4, 14 and 16 continue to apply after an account is closed.

14. Warranty and liability

We work to keep the Service running and your data safe, but it is provided "as is" and "as available". We do not promise that it will always be available, error-free, or suitable for a particular purpose.

As far as the law allows, we are not liable for indirect or consequential losses, lost data or lost profits, and our total liability to you is limited to the amount you paid us in the 12 months before the claim, or €50 if you paid nothing. None of this limits liability for death or personal injury caused by negligence, for fraud, intent or gross negligence, or any other liability the law does not allow us to limit.

You are responsible for claims that arise from content you post or from you breaking these terms, to the extent the law allows.

15. Changes

We may change these terms. Changes will be posted here with a new date. If a change is significant, we will tell you in the app before it takes effect. If you continue to use the Service afterwards, you accept the new terms; if you do not agree, you can delete your account.

16. Law, disputes and the rest

These terms are governed by the law of the Netherlands. If you live in the European Union or another country that protects consumers, you keep the protection of the mandatory law of the country you live in, and you may bring a claim in its courts. Otherwise, disputes go to the competent court in the Netherlands. Please write to us first; most things can be sorted out by email.

If part of these terms turns out to be invalid, the rest still applies. If we do not enforce a term straight away, we have not given it up. You may not transfer your rights under these terms to someone else; we may transfer ours if the Service changes hands, and we will tell you if that happens. These terms and the Privacy Policy are the whole agreement between you and us about the Service.
